Welcome to Dites Earthlings. These Terms & Conditions apply to purchases made through our website.
 

By placing an order through this website, you agree to these Terms & Conditions.

2. Products
 

We sell original acrylic paintings and giclée art prints.
 

Every artwork is created by the artist and may have slight variations in colour or appearance when viewed on different screens. Colours shown on a computer, tablet or mobile device may therefore differ slightly from the physical artwork or print.
 

Product descriptions, photographs and measurements are provided as accurately as reasonably possible.
 

For framed and mounted prints, the specifications are stated on the individual product page.
 

Original paintings are unique artworks. Once an original painting has been sold, that particular artwork may no longer be available.
 

3. Prices
 

All prices are displayed in GBP (£).
 

The price shown at checkout is the price payable for the product, together with any applicable delivery charges.
 

Dites Earthlings is not currently VAT registered, so VAT is not charged separately on purchases.
 

We reserve the right to change product prices at any time. A price change will not affect an order that has already been accepted.
 

We take reasonable care to ensure that prices and product information displayed on the website are accurate. If a genuine pricing or information error occurs, we will contact you as soon as reasonably possible.
 

4. Placing an Order
 

When you place an order, you are making an offer to purchase the selected product.
 

After you place your order, you will receive an order confirmation by email.
 

Your order will be accepted when we confirm that the product has been dispatched, unless we have informed you that your order cannot be accepted.
 

We reserve the right to refuse or cancel an order where, for example, a product is unavailable or there has been an obvious pricing or product-description error.
 

If we cancel an order after payment has been taken, you will receive a full refund.
 

5. Payment
 

Payment is made through the payment methods available at checkout.
 

You must provide accurate payment and contact information when placing an order.
 

Your order will normally only be processed once payment has been successfully received.
 

6. Delivery
 

Delivery options, costs and estimated delivery times are displayed during checkout or on the relevant product/shipping information page.
 

We take care to package artwork securely before dispatch.
 

Once your order has been dispatched, you may receive tracking information where tracking is available.
 

Delivery times are estimates and may occasionally be affected by circumstances outside our reasonable control, such as postal delays, strikes, severe weather or other disruptions.
 

If your order has not arrived within the expected delivery period, please contact us so that we can investigate.
 

Unless otherwise agreed, goods must be delivered within 30 days. 
 

7. International Orders
 

If we offer delivery outside the UK, additional customs duties, import taxes or other charges may apply depending on the destination country.
 

Any such charges that are imposed by the destination country are the responsibility of the customer unless we specifically state otherwise.
 

Customers ordering from outside the UK should check their country’s import requirements before placing an order.
 

8. Right to Cancel
 

If you are a consumer purchasing online, you generally have the right to cancel your order within 14 days of receiving the goods, without giving a reason.
 

After notifying us that you wish to cancel, you normally have a further 14 days to return the goods.
 

The cost of returning an unwanted item is normally the customer’s responsibility unless the item is faulty or we have agreed otherwise.
 

If you cancel in accordance with your statutory cancellation rights, we will refund the relevant payment in accordance with UK law. This includes the cost of standard delivery originally paid, although we do not have to refund any additional amount paid for a more expensive delivery option. Please include your order number and explain that you would like to return your purchase.
 

Returned goods should be sent back safely packaged and in a condition that allows us to assess them in accordance with your statutory rights.
 

You may handle goods to the extent necessary to establish their nature, characteristics and functionality, as you would reasonably be able to do in a shop. If goods have been handled beyond this and their value has been diminished, applicable deductions may be permitted by law. (GOV.UK⁠)
 

10. Exceptions to the Right to Cancel
 

Certain goods may be excluded from the statutory 14-day cancellation right where an applicable legal exception applies.
 

If an exception applies to a particular product, this will be clearly stated before you place your order.
 

11. Faulty, Damaged or Incorrect Items
 

We want every order to arrive safely and as described.
 

If your order arrives damaged, faulty or incorrect, please contact us as soon as possible with your order number and, where appropriate, photographs showing the issue.
 

Your statutory consumer rights are not affected by these Terms & Conditions.
 

Under the Consumer Rights Act 2015, goods supplied to consumers must, among other things, be of satisfactory quality, fit for purpose and as described. Depending on the circumstances, consumers may have rights to reject, repair, replacement or a price reduction. (Legislation.gov.uk⁠)
 

Nothing in these Terms & Conditions excludes or limits any legal rights that cannot legally be excluded or limited.
 

12. Artwork and Copyright
 

All artwork, paintings, photographs, illustrations, designs, text and other creative content displayed on this website are owned by or licensed to Dites Earthlings unless otherwise stated.
 

Purchasing an original painting or art print does not transfer copyright or intellectual property rights to the customer.
 

You may not reproduce, copy, scan, distribute, modify, resell or commercially use any artwork or image from this website without prior written permission.
 

13. Website Content
 

We make reasonable efforts to ensure that information on this website is accurate and up to date.
 

However, we do not guarantee that the website will always be available or completely free from errors.
 

We may update, change or remove website content, products or product availability at any time.
 

14. Personal Information
 

When you place an order, we collect and process personal information necessary to process and deliver your purchase.

15. Limitation of Liability
